Toxic Tort

NZA lawyers have decades of experience in defending toxic tort claims. These include:

  • asbestos
  • chemicals
  • gases
  • mold
  • lead paint
  • food contamination and poisoning

We have defended toxic tort cases throughout the U.S., whether brought by individuals or collectively in class actions. Our lawyers have represented some of the largest U.S. corporations, as well as small companies and individuals, involved in toxic tort or exposure claims. Our extensive experience, trial skills, and reputation lend added resourcefulness to our ability to defend or pursue our clients’ interests, even up to and including trial. Our experience includes:

  • Our attorneys have defended asbestos suits for numerous national U.S. manufacturers for decades. We have represented parties who have mined, sold and manufactured products containing asbestos, and who have had asbestos in their buildings. We have defended direct and second-hand exposure cases.
  • We defended and won at trial in Cook County, Illinois (Chicago) the first toxic mold personal injury case arising in a residential setting.
  • Successfully defended a major university from claims that the presence of mold injured its students.
  • Our partners have successfully represented parties in cases involving chemical discharges. These cases involve a wide range of chemicals. Notable cases include the defense of cases involving the deaths of multiple contractors and rescue workers from argon gas poisoning and a massive highway pile-up after discharge of anhydrous ammonia, causing death and permanent injuries.
  • We have defended large, privately owned food suppliers and food servers for injuries arising locally and nationally from foods contaminated with organisms such as salmonella and listeria.
  • Our attorneys have defended a variety of clients from injuries and deaths due to Legionella exposure.
  • We defended one of the first sick building syndrome (indoor pollution) cases in Illinois brought against the owners and developers of the John Hancock Building.
  • Our partners have defended many construction and manufacturing claims involving exposures to and injuries from chemicals, resulting in grievous bodily harm.
  • We have represented parties in connection with pollution discharges and EPA-mandated cleanups in large-scale litigation.
  • NZA partners have successfully litigated claims resulting from oil and gasoline spills from vehicles, pipelines, and both underground and above-ground storage tanks
